1. Acceptance of Terms

By downloading, installing, or using Noisy Mind ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the App. Noisy Mind is developed and operated by MeltinBit.

2. Description of Service

Noisy Mind is an iOS application that allows users to record voice notes, have them automatically transcribed and refined using AI, and organize them into groups. The App uses a credit-based system: certain AI-powered operations consume credits, which can be purchased through in-app purchases.

3. Account

To use Noisy Mind, you must sign in using Apple's Sign In with Apple. You are responsible for maintaining the security of your Apple account. We are not liable for any loss or damage arising from unauthorized access to your account.

You must be at least 13 years old to create an account and use the App.

4. Credits and In-App Purchases

Noisy Mind operates on a credit-based model. Credits are required to perform AI operations such as transcription, refinement, and condensing of notes. Credits are purchased through Apple's in-app purchase system and are non-refundable, except as required by applicable law or Apple's refund policies.

Credits have no monetary value and cannot be transferred, exchanged, or redeemed for cash. Unused credits do not expire as long as your account remains active.

All billing and payment processing is handled exclusively by Apple. MeltinBit does not collect or store any payment information.

5. Acceptable Use

You agree to use Noisy Mind only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the App to record, transcribe, or process content that is illegal, harmful, defamatory, or that violates the rights of others
  • Attempt to reverse engineer, decompile, or modify the App or its underlying systems
  • Use automated means to access or interact with the App
  • Attempt to circumvent the credit system or exploit any vulnerability in the App
  • Use the App in any way that could damage, disable, or impair our servers or infrastructure

6. AI-Generated Content

Noisy Mind uses third-party AI services (OpenAI) to transcribe and process your voice recordings. The results are generated automatically and may not always be accurate, complete, or appropriate. You are solely responsible for reviewing, editing, and using any AI-generated content produced by the App. MeltinBit does not guarantee the accuracy or quality of transcriptions or AI-processed text.

7. Audio Recordings and Privacy

Your voice recordings are transmitted to our servers solely to be forwarded to the transcription service and are never stored. Transcribed and processed text is returned to your device and is not retained on our servers. You are responsible for ensuring that any recordings you make comply with applicable laws, including any consent requirements for recording conversations with third parties.

8. Intellectual Property

All content, design, code, and trademarks associated with Noisy Mind are the property of MeltinBit or its licensors. The App is licensed to you, not sold. You may not reproduce, distribute, or create derivative works based on the App or its content without our written permission.

You retain all rights to the content you create using the App, including your original voice recordings and the resulting transcribed text.

9. Availability and Updates

We strive to keep Noisy Mind available and functioning, but we do not guarantee uninterrupted or error-free service. We may update, modify, suspend, or discontinue the App or any of its features at any time, with or without notice.

In the event that the App is discontinued, we will make reasonable efforts to notify users in advance.

10. Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, MeltinBit is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of credits, or inaccurate transcriptions.

Our total liability to you for any claim arising from the use of the App shall not exceed the amount you paid for credits in the three months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ferrara, Italy.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version with an updated date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
